The lawsuit over a drive-thru window in Cape Girardeau is now going to federal court. On Monday the city of Cape Girardeau and other defendants named in the legal challenge filed paperwork to move the case from circuit court to a United States District Court.A group of property owners sued the city, the operators of Roni’s Mac Bar and the owners of the building in November after city leaders approved a permit for a drive-thru window.The property owners argue the drive-thru window will be a traffic hazard by blocking access to an alley used by tenants.
